China Corporate Tax & VAT for Foreign Businesses (2026)

Operating a business in China requires a solid understanding of the country's tax system. For foreign investors, the two most significant taxes are Corporate Income Tax (CIT) and Value-Added Tax (VAT), but a number of other levies — including withholding tax, surcharges, stamp duty, and individual income tax for employees — also demand attention. This 2026 guide outlines the key taxes, rates, incentives, and compliance obligations relevant to foreign-invested enterprises (FIEs) in China.

➦ Corporate Income Tax (CIT)

CIT is levied on the worldwide income of resident enterprises and on the China-sourced income of non-resident enterprises with establishments in China. The standard CIT rate is 25%.

  • Standard rate: 25% for most enterprises.
  • Small and micro enterprises: qualifying small low-profit enterprises enjoy a reduced effective tax rate of 5% (calculated as 25% of taxable income × 20% tax rate) through to December 31, 2027, per Ministry of Finance and State Taxation Administration Announcement No. 12 of 2023.
  • High-tech enterprises (HTE): certified high-tech enterprises are entitled to a reduced CIT rate of 15%.
  • Technologically advanced service enterprises (TASE): may also qualify for a reduced rate of 15% in certain regions.
  • Preferential policies for specific industries: encouraged industries in certain regions (e.g., Hainan Free Trade Port, Western China) may enjoy reduced CIT rates (as low as 15% or even 0% for some qualifying income).

CIT is filed quarterly on a provisional basis and settled annually through an annual reconciliation (汇算清缴) by 31 May of the following year.

➦ Value-Added Tax (VAT)

VAT is levied on the sale of goods, provision of services, and importation of goods. China operates a credit-invoice system, where input VAT can generally be offset against output VAT.

  • Standard rate for goods and most services: 13%.
  • Low rate: 9% for transportation, postal services, basic telecommunications, construction, and certain agricultural products.
  • Lower rate: 6% for financial services, modern services, and life services.
  • Small-scale taxpayers: may apply a simplified levy rate of 3% under the VAT Law, with a temporary reduction to 1% from January 1, 2026 to December 31, 2027 for most transactions, per Ministry of Finance and State Taxation Administration Announcement No. 10 of 2026.
  • Export of goods: generally zero-rated, with input VAT refundable.

VAT filing is typically monthly (or quarterly for small-scale taxpayers) via the electronic tax bureau. Proper issuance and management of special VAT invoices (fapiao) is critical for claiming input credits.

➦ Withholding Tax (WHT) on Payments to Non-Residents

When a Chinese enterprise pays dividends, interest, royalties, or certain service fees to a non-resident enterprise without a permanent establishment in China, withholding tax applies. The statutory rate under the Enterprise Income Tax Law is 20%, but has been reduced to 10% under State Council implementing regulations — meaning 10% is the rate practitioners actually apply in 2026. This rate may be further reduced under an applicable tax treaty.

  • Dividends: 10% (or treaty rate, often 5% or lower).
  • Interest: 10% (treaty rates may apply).
  • Royalties and licensing fees: 10%.
  • Capital gains: generally taxed at 10% on the gain.

Proper treaty analysis and filing of treaty benefit applications are essential to reduce WHT exposure.

➦ Surcharges and Other Taxes

  • Urban maintenance and construction tax: typically 7% (urban), 5% (county/town), or 1% (other areas) of the actual VAT and consumption tax paid.
  • Education surcharge: 3% of VAT and consumption tax.
  • Local education surcharge: 2% of VAT and consumption tax.
  • Stamp duty: applies to specified contracts, documents, and share transfers. Rates are generally low (0.005% to 0.1%).
  • Real estate tax: levied on property owners or users at 1.2% of the original value (or 12% of rental income).
  • Deed tax: 3%-5% on real estate transfers.

📌 Note: In August 2026, the Ministry of Finance initiated public consultation on a proposed Local Surcharge Tax Law, which would consolidate the urban maintenance and construction tax, education surcharge, and local education surcharge into a single local surcharge tax at a rate of 11% to 13%. This legislation is still in the draft stage; we will update the page once final measures are issued.

➦ Individual Income Tax (IIT) for Foreign Employees

Foreign employees working in China are subject to IIT on their China-sourced income. The progressive rates range from 3% to 45% (comprehensive income).

  • Monthly withholding by the employer is mandatory.
  • Annual reconciliation is required for comprehensive income (wages, salaries, labor remuneration, author's remuneration, royalties).
  • Special additional deductions (e.g., children's education, housing loan interest) may reduce taxable income for residents.
  • Non-resident taxpayers are taxed only on China-sourced income, often with simplified filing.

➦ Key Tax Incentives and Preferential Policies (2026)

  • High-tech enterprise (HTE) status: reduced CIT rate of 15% and extended loss carryforward (up to 10 years).
  • Research and development (R&D) super deduction: qualifying R&D expenses incurred from 2023 onwards may be deducted at 100% above the actual amount (with certain industries such as integrated circuits and machine tools eligible for 120% until December 31, 2027).
  • Small and micro enterprise relief: reduced CIT effective rate of 5% and VAT exemptions for qualifying taxpayers, effective through December 31, 2027.
  • Regional incentives: Hainan Free Trade Port offers 15% CIT for encouraged industries and 0% for certain new foreign direct investment income; Western regions offer 15% CIT for encouraged industries.
  • Greater Bay Area (GBA) incentives: eligible overseas high-end talents and urgently needed talents may receive a subsidy equivalent to the IIT burden above 15%.
  • Technology transfer: income from qualified technology transfers may be exempt from CIT up to RMB 5 million, with a 50% reduction on the excess amount.

➦ Compliance and Filing Deadlines

  • VAT and surcharges: monthly or quarterly, due within 15 days after the end of the period.
  • CIT provisional filing: quarterly, due within 15 days after the quarter-end.
  • Annual CIT reconciliation: by 31 May of the following year.
  • IIT withholding: monthly, due within 15 days after the month-end.
  • Annual IIT reconciliation: 1 March to 30 June of the following year for resident taxpayers with comprehensive income above thresholds.
  • Stamp duty: due upon execution of taxable documents.

Late filing or underpayment may result in late fees and penalties (0.05% per day for late payment). Maintaining accurate books and valid invoices is crucial.
