On 15 September 2026, the Provisions of the State Council on the Administration of Exit and Entry (State Council Decree No. 841) came into force. The Provisions do not change visa categories, work permit criteria or the standard application process. What they change is the legal consequence of the information submitted: truthfulness becomes an enforceable obligation, and responsibility for that information is allocated between the foreign national, the entity issuing the invitation or supporting documents, and any intermediary involved in the application.
This page is written for two audiences. Foreign nationals need to understand which scenarios create personal immigration risk. Employers and HR teams need to understand that signing an invitation letter or supporting a work permit application is no longer an administrative formality. Use the navigation below to go directly to the section relevant to you.
Article 5 of Decree No. 841 provides that a foreign national who, when applying for a Chinese visa outside China or applying for entry at a port, provides false materials or makes false statements, may be subject to a decision prohibiting entry for one to five years. The same one-to-five-year entry ban applies where the foreign national has been subject to criminal punishment for obstructing border management, or administrative penalty for fraudulently obtaining exit-entry documents or illegal exit or entry, calculated from the date the penalty is completed.[reference:8]
The Provision does not create a separate list of “high-risk scenarios”. The risk arises wherever the information submitted to the visa or immigration authority does not match the facts. Three fact patterns illustrate how a mismatch can arise in practice.
| Fact pattern | Why it engages Article 5 | Statutory consequence |
|---|---|---|
| Work permit arranged through an entity that is not the actual employer | The application identifies one entity as the sponsoring employer, while the foreign national is in fact managed and paid by another. The information submitted does not reflect the actual employment relationship, which engages the truthfulness obligation under Article 3 and the false-statement provision under Article 5. | Refusal of the application; one-to-five-year entry ban under Article 5 where false materials or statements are found.[reference:9] |
| Paid work conducted on a visa that does not authorise employment | Where the foreign national engages in paid work without a valid work permit, the activity is not covered by the stated purpose of the visa or entry. This is separately addressed by the illegal employment provisions of the Exit and Entry Administration Law (Article 80). | Illegal employment penalties under Article 80 (see the penalty table below); where the visa application itself involved a false statement of purpose, the Article 5 entry ban may also apply. |
| Visa category inconsistent with the actual purpose of stay | Entering on a visa whose category does not match the actual activity constitutes a purpose mismatch. Article 3 requires the purpose to be genuine, and Article 5 addresses false statements made at the visa or entry stage. | Administrative penalties; possible refusal of entry or cancellation of stay; one-to-five-year entry ban under Article 5 where false statements are established.[reference:10] |
If you are already in China and are unsure whether your current visa or residence permit matches your actual activity, the lawful pathway is set out in the Work Permit & Z Visa page, and the linkage between the two documents is explained in the Residence Permit page.
Article 11 of Decree No. 841 creates a separate penalty for issuing false invitation letters or other application materials. The provision distinguishes between an individual issuer and a unit issuer. For an individual who issues false invitation letters or other application materials for another person, the immigration authority may impose a fine of RMB 5,000 to 10,000, and confiscate any illegal gains.[reference:11] For a unit, the fine is RMB 10,000 to 50,000, with confiscation of illegal gains, and the directly responsible managers and personnel may each be fined RMB 5,000 to 10,000.
The practical consequence is direct: the person who signs the invitation letter, and the entity whose seal is affixed to it, are the parties legally responsible for the accuracy of its contents. The checklist below is limited to the obligations created by Articles 3, 7 and 11 of Decree No. 841.
For a newly established company, the entity that registers the company must also be the entity that sponsors the work permit. The China Entity Comparison explains the structural reason, and the Company Registration overview sets out the sequence between establishment and sponsorship.
Decree No. 841 and the Exit and Entry Administration Law operate alongside each other. Decree No. 841 addresses the truthfulness of the application and the liability of the issuer of supporting documents. The Law addresses illegal employment and activities inconsistent with the stated purpose of stay. The table below sets out the statutory consequences side by side.
| Conduct | Consequence for the foreign national | Consequence for the entity or individual |
|---|---|---|
| Providing false materials or making false statements when applying for a visa outside China or applying for entry at a port | One to five years prohibited from entering China (Decree No. 841, Article 5).[reference:15] | — |
| Issuing a false invitation letter or other application materials | — | Individual: fine of RMB 5,000–10,000. Unit: fine of RMB 10,000–50,000, plus fines of RMB 5,000–10,000 for directly responsible managers and personnel. Illegal gains confiscated (Decree No. 841, Article 11).[reference:16] |
| Foreign national working without a valid work permit or residence permit | Fine of RMB 5,000–20,000; in serious circumstances, detention of five to fifteen days and a fine of RMB 5,000–20,000 (Exit and Entry Administration Law, Article 80, paragraph 1).[reference:17] | Employing an unauthorised foreign national: fine of RMB 10,000 per person, up to a total of RMB 100,000; illegal gains confiscated (Exit and Entry Administration Law, Article 80, paragraph 3).[reference:18] |
| Engaging in activities inconsistent with the stated purpose of stay or residence | May be ordered to leave within a specified period; in serious circumstances, deportation, with a ten-year re-entry ban from the date of deportation (Exit and Entry Administration Law, Article 81).[reference:19] | Liability depends on the entity's role in supporting the mismatched application; where the entity issued false materials, Article 11 of Decree No. 841 applies. |
To state the scope precisely:
The change is concentrated in two places: the truthfulness and consistency of the information submitted (Article 3 and Article 5), and the accountability of the party that issues the supporting documents (Article 3 and Article 11). A foreign national and an employer whose application materials have been accurate and internally consistent from the outset have little to adjust. The risk arises where the application has been structured around administrative convenience rather than the actual facts.
The pages below set out the lawful process for each pathway. If you are planning an application, read the relevant service page first. If you are reviewing an existing arrangement, the Contact Us page is the starting point for a case-specific assessment.
