Foshan Address Compliance for Foreign Investors: What Changed in 2026 and How to Register a WFOE Now

Reviewed by: Finerise Corporate Services Team Applies to: Foreign investors registering or relocating a company in Foshan Legal basis: 佛府办〔2023〕17号;佛市监注〔2026〕129号;2026年8月11日通告
The key change in one paragraph: Foshan has moved from a system where a company could register at a self-compiled address by signing a declaration (住所信息申报) to a system where the address must either be pre-recorded in the Standard Address Database by the property owner, or the company must register at the exact address stated on the property ownership certificate. From 1 September 2026, the declaration route is fully suspended city-wide. For foreign founders, this means the address is no longer something that can be arranged after the lease is signed — it is a pre-condition that must be verified before or alongside the company registration application.
What is no longer possible: Subdividing an unrecorded building and using a self-compiled description such as “Room 201-2” or “Unit 3A” for company registration. If the building is not in the Standard Address Database, the only address that can be registered is the one on the property ownership certificate — even if the lease describes the premises differently.

1. What changed: the 1 September 2026 turning point

The reform has two layers, and they took effect on different dates.

From 1 July 2026, the Foshan Administration for Market Regulation began requiring that self-compiled addresses used for registration be matched against the Standard Address Database (自编标准地址库). A self-compiled address — for example, a subdivided unit within a larger building — had to be entered into the database by the property owner or an authorised operator, and pass platform verification, before it could be used in a company registration application.(佛山市市场监督管理局2026年6月30日通告)

From 1 September 2026, the city fully suspended the address self-declaration system (住所信息申报). Previously, an applicant could in some circumstances register by submitting a declaration and commitment letter instead of full address proof. That route is now closed. Applicants must either rely on a pre-recorded address with the appropriate ownership and usage-rights information already uploaded, or submit full lawful address proof matching the property-title address.(佛山市市场监督管理局2026年8月11日通告)

The practical consequence is a narrowing of options. Before September, there were cases where an address could be used through a declaration even if the landlord had not completed the database entry. After September, the database status or the property-title match determines what is possible. The two paths below are the only ones that remain.

2. The two legal paths that remain

Path A — self-compiled address
Property owner pre-records the unit in the Standard Address Database
The landlord (or an authorised operator) logs into the Foshan self-compiled address management platform, uploads the property ownership documents, the floor plan showing the subdivision, on-site geotagged photographs, and the proposed unit numbering. After platform verification, the unit can be used for company registration. The tenant’s document burden depends on what the landlord uploaded — see the next section.
Path B — original property-title address
Company registers at the exact address on the ownership certificate
If the building is not in the database, or the landlord cannot or will not complete the recording, the company can still register — but only at the address exactly as it appears on the property ownership certificate. A lease that describes the premises as “Room 201-2” or “Unit 3A” does not override the certificate address for registration purposes. The tenant submits full lawful address proof: the certificate, the lease and, where applicable, the free-use agreement.

There is no third path. The previous declaration-based route has been suspended. Cluster registration (集群登记) remains available under separate rules, but it is not a substitute for a physical business address where the business scope or district window requires one.

3. Document tiers: what you submit depends on what the landlord uploaded

If the address has been pre-recorded, the document exemption is tiered, not binary. The table below reflects the current notice.

Database and upload statusWhat the tenant submitsPractical implication
Address recorded + ownership AND usage rights fully uploaded Exempt from address proof documents (property certificate, lease, free-use agreement). The tenant enters the recorded address ID in the registration application. Best case. The landlord has done the full upload. The tenant’s address documentation burden is minimal.
Address recorded + only ownership uploaded Proof of usage rights only (typically the lease or free-use agreement). No need to submit the ownership certificate. Common case. The tenant still provides the lease, but the ownership layer is already verified.
Address NOT recorded Full lawful address proof matching the property-title address: ownership certificate + lease or free-use agreement. Self-compiled unit descriptions cannot be used. Most restrictive. If the lease uses a self-compiled unit number, the registration address must revert to the certificate address.
Why “fully uploaded” matters for landlords: A landlord who uploads only the ownership certificate shifts the document burden to the tenant. A landlord who uploads both ownership and usage rights makes the property more attractive to foreign tenants who want a lighter registration file. For multi-tenant commercial buildings, the operator should aim for the full-upload status.

4. Practical steps for foreign founders and their landlords

The sequence below reflects how the process actually runs when the address is a self-compiled unit in a commercial building, industrial park or subdivided property.

  1. Before signing the lease, check the database status. Ask the landlord whether the specific unit has already been pre-recorded. If the answer is vague, treat the address as unrecorded until verified. The Foshan platform does not offer a fully public self-service lookup for all unit statuses, so the confirmation usually comes from the landlord or the park operator.
  2. If it is not recorded, the landlord acts first. The property owner or authorised operator logs into https://zhjg.fsamr.foshan.gov.cn/address/ and submits the building information, geotagged photos, floor plan with unit numbering, and ownership/usage documents. Platform verification is required before the unit can be used. In practice this can take one to two weeks or longer depending on document completeness and district workload.
  3. Run the address process in parallel with company preparation. Name pre-approval, investor document legalisation (apostille or consular authentication) and the address recording can proceed at the same time. Do not wait for the lease to be signed before starting the legalisation of investor documents — that is the most common source of avoidable delay.
  4. Match the registration address to what is legally usable. If the address is recorded and the tenant qualifies for an exemption, use the recorded address ID. If the address is not recorded, use the exact property-title address in the registration application, even if the lease uses a different unit description. Mismatches between the lease, the certificate and the registration application are a frequent cause of rejection.
  5. Confirm district window practice before submission. The city-wide rule is uniform, but district windows may differ in how they check the address ID, what they accept as proof of usage rights, and how they handle cases where the lease unit and certificate address diverge. A quick confirmation with the receiving window — or through a local adviser who deals with that district — reduces the risk of a back-and-forth.

5. District differences and local tools

The underlying rule applies across all five districts — Chancheng, Nanhai, Shunde, Gaoming and Sanshui — but the supporting tools and the volume of applications differ.

Shunde has been the most active in building applicant-facing tools. In October 2026, the Shunde government launched a self-compiled address filing assistant on its “顺德政务百事通” platform. The tool walks property owners and operators through the filing process: it asks whether the applicant is the property owner or an operating entity, clarifies the ownership and sublease situation, generates a tailored document checklist, and provides step-by-step guidance across ten filing stages.(顺德区政务服务和数据管理局,2026年10月21日) For landlords in Shunde, this reduces the trial-and-error that has caused repeated rejections.

Chancheng and Nanhai have run district-level training sessions on the recording rules, particularly for industrial parks, commercial complexes and village collective properties. The focus has been on clarifying what counts as a “self-compiled address” and what documents the operator must prepare. Gaoming and Sanshui follow the same city-wide framework, with Sanshui having piloted the recording model earlier at the sub-district level.

For foreign tenants, the district matters less than the landlord’s readiness. A landlord in any district who has already completed the recording and uploaded both ownership and usage rights will produce a smoother registration than a landlord in a “fast” district who has not. The practical due-diligence question is not “which district is easiest” but “has this specific unit been recorded, and what has the landlord uploaded?”

Frequently Asked Questions

Can I still use a self-compiled address in Foshan after September 2026?
Yes, but only if the self-compiled address has been pre-recorded in the Foshan Standard Address Database by the property owner or an authorised operator, and has passed platform verification. Since 1 September 2026, the address self-declaration system has been fully suspended, so the previous route of signing a declaration without a pre-recorded address is no longer available.
What happens if the landlord has not recorded the address?
The company cannot register at a subdivided self-compiled address. The only remaining option is to register at the exact address stated on the property ownership certificate or other lawful proof of address. Subdividing an unrecorded building into “Room 201-1” or similar self-compiled descriptions is not permitted for registration purposes.
What documents do I need if the address is already in the database?
It depends on what the property owner uploaded. If both ownership and usage rights information are recorded, the tenant may be exempt from submitting address proof documents such as the property certificate, lease or free-use agreement. If only ownership is recorded, the tenant still needs to provide proof of usage rights (typically the lease). If the address is not recorded, the tenant must provide full lawful address proof matching the property-title address.
Does the suspension of address self-declaration apply to all districts in Foshan?
Yes. The Foshan Municipal Administration for Market Regulation notice applies city-wide, covering Chancheng, Nanhai, Shunde, Gaoming and Sanshui. District-level implementation tools may differ — for example, Shunde launched a dedicated self-compiled address filing assistant in October 2026 — but the underlying rule that self-compiled addresses must be pre-recorded is uniform across the city.
How long does the landlord’s pre-recording take, and can it be done in parallel with company registration?
The platform verification timeline varies, but in practice it can take one to two weeks or longer depending on the completeness of the property documents and the district window’s workload. It should be started as early as possible and can run in parallel with name pre-approval and investor document legalisation, but the company registration application cannot be finalised until the address is either recorded or confirmed as matching the property-title address.
